I signed a agreement to buy a house a while ago and was having difficulty securing financing. The contract expired and they attorney called me and wants me to turn over a real estate release form and he would give me half of my earnest money back. He said he wants to do me a favor and give me something back because he said the owners of the territory don't have to give me anything back. This story just sounds fishy to me. Am I entitled to all of my earnest money back and he is virtuous trying to get me to sign half of it away? Thanks
Answer: You will demand to read your contract to make this determination. If your offer was subject to financing and you were powerless to secure said financing under those conditions, you should be entitled to a full refund.
