this may be activated complicated....but i'm confused and dont know how to explain this to some friends.....okay, here goes
1. Two mexicans worked legally (with H2B visas) in the Amalgamated States.
2. They really received the visas sometime around the end of November 2007.
3. So, they were here legally from November 2007 and were hypothesize to return to mexico in July or August (can't remember) 2008....but they were issued a 3 month lengthening.....which put them to return to mexico in either October or November 2008....but they left in November 2008 (so perhaps the extension expired in November)
now, i'm sure when you exit the U.S. you have to turn in your passport, visa, and whatever else documents (not steady)
well, they received a W-2 for work year 2008....
1. Since they are gone, do they still have to file? If they do not, what happens to them?
2. I think someone told me they should interfile as resident aliens (giving the amount of days "lived" in the U.S. November 2007-November 2008)..is that become a reality? If not, should they file as non-resident aliens?
3. One is married with two children, the other is single with one child....can they require them as dependants?
4. I was told if they want to claim them as dependants, then file form W-7 along with tax return.
the two mexicans were issued SSNs that says "valid for exertion only with DHS authorization"
now, the dependants never came to the U.S. so they dont have SSNs, but to claim them they dearth something similar??
I took a look at the w-7 and it says applicant's name
1. whose name goes in the blank (the dependant or the remaining alien)?
2. it says mailing address and foreign address if different from mailing speak (is that of the dependant or the resident alien?).....and if it is the resident alien (do they put their U.S. address for the mailing speech or their home address in mexico?)
3. all of section 6 (is that the dependant or resident distance from?)
4. which box do they check (box c,d,or both?) and for the married one (box c,d,e,or all?)
5. also for the married guy...does he have to fill out three seperate forms (one for each child and another for the spouse?)
i tried vocation the irs.....but the line to get through takes forever
any help would be appreciated,thanx
do the neighbouring aliens have to file for an ITIN too?
i ask because they have already gone back to mexico and I'm not sure if the SSNs they were isssed are still vaild to use for their tax returns(although they were only vaild for trade...and it is on the w2)

no more than a reminder.....the visas were H2-B........not H1-B
i believe there is a difference in each.
do the resident aliens have to march for an ITIN too?
